Terms of Service

By downloading, installing, accessing, or using Pynch ("the App"), you agree to be bound by these Terms of Service ("Terms"). The App is operated by Flip Tech Ltda ("we," "us," or "our"), a company registered in Brasília, DF, Brazil.

If you do not agree to these Terms, do not use the App. We may update these Terms from time to time. Material changes will be posted at pynchapp.com/terms with an updated date. Your continued use of the App after changes constitutes acceptance.

You must be at least 13 years old to use the App (or at least 16 years old if you reside in the European Economic Area). By using the App, you represent that you meet this age requirement.

Pynch is a personal wellness application that helps users track their GLP-1 medication journey. The App includes both free and premium features:

• Dose logging — record when you take your medication, including injection site tracking
• Weight tracking — log your weight over time and visualize trends
• AI-powered food estimation — photograph or describe meals to estimate calories and macronutrients
• Side effect journaling — record symptoms and how you're feeling
• Daily wellness check-ins — track food noise, wellness, and daily goals
• Progress photos — take and store photos locally on your device
• Nutrition goals — set calorie and macro targets
• Injection site rotation — track where you administer injections

By using Pynch, you understand and agree that:

• Dose logging records information that you enter. Pynch does not calculate, recommend, or suggest medication dosages. Always follow your healthcare provider's prescribed dosing schedule.
• Weight trends and progress visualizations are for informational and motivational purposes only. They do not represent clinical assessments of treatment efficacy.
• AI food estimates are approximate and are not certified by nutritional professionals. They should not be relied upon for medical dietary requirements or clinical nutrition decisions.
• Side effect logging is a personal journal feature. Pynch does not diagnose side effects, assess their severity, or provide medical triage.
• Nutrition goals and calculations are based on general formulas and may not reflect your individual needs. Consult a healthcare provider or registered dietitian for personalized nutrition guidance.

Always consult your healthcare provider before making any changes to your medication, diet, or exercise routine. If you experience a medical emergency, contact your local emergency services immediately.

You can use Pynch without providing personal information. An anonymous account with a unique identifier is created automatically when you start using the App.

You may optionally sign in with your Apple ID or Google account for data backup and account recovery. If you do:

• You are responsible for maintaining the security of your device and account credentials
• You are responsible for all activity that occurs under your account
• You must notify us promptly of any unauthorized access

Pynch offers optional AI-powered food estimation that analyzes food photos and descriptions to estimate calories and macronutrients. By using these features, you understand that:

• Consent is required before first use and can be revoked at any time
• Food photos and text descriptions are sent to third-party AI providers (Google Gemini and/or OpenAI) for processing
• No personally identifiable information (name, email, user ID, or health data) is sent to AI providers
• AI estimates are approximate and may be inaccurate. They are not certified by nutritional professionals and should not be relied upon for medical or clinical nutrition decisions
• AI providers process data according to their own privacy policies

You retain full ownership of all content you create in the App including dose logs, weight entries, food logs, progress photos, notes, and other personal data. We do not claim any ownership over your health data.

By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, display, and transmit your content solely for the purpose of providing the App's services to you. This license terminates when you delete your account.

Progress photos are stored locally on your device and are not uploaded to our servers.

The App name, logo, design, and all original content, features, and functionality are owned by Flip Tech Ltda and are protected by international copyright, trademark, and other intellectual property laws.

You agree not to:

• Use the App for any illegal purpose
• Use the App to provide medical advice, diagnoses, or treatment recommendations to others
• Misrepresent data generated by the App as medical or clinical information
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the App or its servers
• Reverse engineer or decompile the App
• Use automated systems to access the App or scrape data
• Attempt to circumvent premium feature restrictions or subscription requirements
• Impersonate another person or entity

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing:

• We do not guarantee the accuracy of AI food estimates, calorie calculations, or nutrition projections
• Weight loss projections and pace estimates are based on general formulas and may not reflect your actual results
• Information about GLP-1 medications displayed in the App is for educational purposes only and may not be current or complete
• We do not guarantee that the App will be uninterrupted, secure, or error-free

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIP TECH LTDA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.

IN NO EVENT SHALL PYNCH OR FLIP TECH LTDA BE LIABLE FOR ANY HEALTH-RELATED DECISIONS MADE BASED ON INFORMATION DISPLAYED IN THE APP, INCLUDING BUT NOT LIMITED TO MEDICATION DOSING, DIETARY CHOICES, OR EXERCISE DECISIONS. YOU ACKNOWLEDGE THAT THE APP IS A WELLNESS TRACKING TOOL AND THAT ALL HEALTH DECISIONS SHOULD BE MADE IN CONSULTATION WITH A QUALIFIED HEALTHCARE PROVIDER.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS LESS.

You may delete your account at any time from the App's Settings. Upon deletion:

• All your data is permanently and irreversibly removed from our servers
• Progress photos stored locally on your device are not automatically deleted — you may remove them manually
• Active subscriptions are not automatically cancelled. You must cancel your subscription separately through your device's Settings > [your name] > Subscriptions

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that may harm the App, our users, or third parties.

These Terms are governed by the laws of the Federative Republic of Brazil. The forum of Brasília, Distrito Federal, Brazil shall have jurisdiction over any disputes arising from these Terms, except as set forth below.
